The following Terms and Conditions shall apply to all services provided by VTeck IT & Digital Solutions LLP and its wholly owned brand, collectively referred to as "Cloud eSIM."

The terms "we," "us," and "our" refer to Cloud eSIM and its subsidiaries. "you," "your," "user," or "visitor" refers to any natural or legal person visiting our website, using our mobile applications, or purchasing from us.

General Terms

Cloud eSIM engages in the resale of prepaid eSIMs and Virtual Numbers (DID). Customers may register and purchase eSIMs through:

• Mobile applications: Cloud eSIM App

Payments are processed through trusted platforms, including:

• PhonePe

Accepted payment methods include UPI, Credit/Debit Cards, and Net Banking through PhonePe and other available options provided by the platform. Payments are conducted in Indian Rupees (₹).

These Terms and Conditions are accessible on Cloud eSIM's website and mobile applications. By using our website, mobile applications, or purchasing from us, you agree to these Terms and Conditions.

Additional Provisions for Subsidiaries

Cloud eSIM, operate as brand of VTeck IT & Digital Solutions LLP and adhere to these Terms and Conditions. For services provided by these subsidiaries, the governing laws and jurisdiction clauses outlined below are subject to the legal system of India, unless otherwise specified.

• The content of the pages of this website is subject to change without notice.
• Customers are responsible for ensuring that their device is compatible with eSIMs and is network-unlocked. Device compatibility may vary depending on the carrier and country of origin; Customers are advised to check the list of eSIM-compatible devices provided during checkout. By confirming that the Customer's device is eSIM compatible, the Customer assumes responsibility for the accuracy of the provided information. The eSIM compatibility list is not exhaustive, and newly announced eSIM-compatible devices may need to be added.
• The service contract between Cloud eSIM and the Customer commences upon the completion of the order on the Cloud eSIM website https://www.cloudsim.in or through the Cloud eSIM app. The activation of the eSIM and compliance with the Activation Policy are the sole responsibilities of the Customer. The contract will be terminated if the Customer lacks an active data package or deletes the eSIM from the target device.
• Cloud eSIM affirms that all Charges are inclusive of VAT unless explicitly stated otherwise. The Customer is not entitled to offset any claims against Cloud eSIM's claims, except when the Customer's claims are undisputed or have been confirmed by a final court judgment.
• Upon purchase, the Customer will promptly view the acquired eSIM under the "My eSIMs" section on the Cloud eSIM website https://www.cloudsim.in and/or the Cloud eSIM app. A confirmation email will be sent to the Customer after the purchase, and installation information will be exclusively available on the user's Cloud eSIM account.

Cloud eSIM Coins

In Cloud eSIM's credit reward system, known as Cloud eSIM Coins, users enjoy a cashback directly credited to their Cloud eSIM accounts. These Coins are earned as a purchase reward when transactions are made using various payment methods such as Credit / Debit Card, Mobile Banking. It's important to note that earning Cloud eSIM Coins is not applicable when discounts or referral rewards are applied to the purchase.

Customers have the flexibility to use Cloud eSIM Coins for their purchases or combine them with other payment methods like UPI, Credit / Debit Card, and Net Banking via PhonePe. The reward amount in Cloud eSIM Coins for combined payments is directly proportionate to the amount paid through these methods. However, it's worth mentioning that any existing Cloud eSIM Coins in a user's account cannot be converted to any other form of credit and are exclusively credited to the user's Cloud eSIM account for future transactions.

Furthermore, users should be aware that Cloud eSIM Coins, whether earned or to-be-earned, are strictly non-transferable between different Cloud eSIM accounts, ensuring the integrity of the reward system.

• Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
• Your use of any information or materials on our website and/or product pages is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through our website and/or product pages meet your specific requirements.
• Our website & Mobile applications contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.
• All trademarks reproduced in our Website & Mobile applications which are not the property of, or licensed to, the operator are acknowledged on the website.
• Unauthorized use of information provided by us shall give rise to a claim for damages and/or be a criminal offense.
• From time to time our Website & Mobile applications may also include links to other websites. These links are provided for your convenience to provide further information.
• You may not create a link to our Website & Mobile applications from another website or document without VTeck IT & Digital Solutions LLP’s prior written consent.

Third-Party Services

If the Customer decides to enable, access, or use third-party services, please note that the interaction with those services is governed solely by their terms and conditions. Cloud eSIM does not endorse and is not responsible for any aspect of these services, including their content or data handling practices. The Customer waives any claims against Cloud eSIM regarding such services. Cloud eSIM is not liable for any damage or loss related to the Customer's use of these services, and the Customer expressly permits Cloud eSIM to disclose their data to facilitate their use. The Customer may need to register or log in on the respective platforms of these services.

Jurisdiction

1. For services provided by VTeck IT & Digital Solutions LLP, disputes are governed by the laws of India, subject to the jurisdiction of the courts of Mumbai, Maharashtra.

• We shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
• Cloud eSIM is not liable for damages arising from the unavailability of the proposed service. Cloud eSIM does not guarantee constant availability of the network service. To the fullest extent allowed by law, Cloud eSIM, its affiliates, and partners will not be liable for any indirect, incidental, or consequential damages, including lost profits or business interruption. This applies under any theory of liability, even if Cloud eSIM has been advised of the possibility of such damages. Cloud eSIM's aggregate liability is limited to the greater of one dollar or the amount paid in cash by the Customer for the prior one-month period. These limitations also apply if this remedy does not fully compensate the Customer for any losses or fails of its essential purpose.
